DMCA Takedown Requests

HostRocket responds to notices of alleged copyright infringement under the Digital Millennium Copyright Act of 1998. Further information about the Act is available from the US Copyright Office at https://www.copyright.gov/legislation/dmca.pdf.

When we receive a valid notice we disable access to the material identified and contact the customer responsible. That customer then has the opportunity either to remove the disputed content themselves or to submit a counter notification if they dispute the claim. If they do neither, the account is suspended in accordance with our Terms of Service.

Sending us a notice

A notice may be sent by email and will be acted on. The items below are what the law requires, and a notice that substantially meets points 1 to 6 will be processed even if it does not follow our preferred layout.

  1. A physical or electronic signature of a person authorised to act on behalf of the owner of the right said to be infringed. A typed name at the end of an email is acceptable as an electronic signature.
  2. Identification of the copyrighted work you say has been infringed.
  3. Identification of the material you say is infringing, with enough information for us to locate it. The full URL of each item is the most useful form of this.
  4. Your name, address, telephone number and email address, so that we and the customer can contact you.
  5. A statement that you have a good faith belief that the use of the material is not authorised by the copyright owner, its agent, or the law.
  6. A statement that the information in the notice is accurate and, under penalty of perjury, that you are the owner of the right concerned or are authorised to act on the owner's behalf.

The following are not required, but they help us act more quickly if you can include them:

  • The date you discovered the material.
  • Registration details for the work, if it is registered.
  • The action you would like us to take.

We reserve the right to request a hard copy of a notice by post, sent to the address below, although this is not necessary to begin the process.

Counter notification

If you are a customer and material of yours has been disabled following a notice, you may submit a counter notification. It should identify the material and its former location, state under penalty of perjury that you have a good faith belief the material was disabled as a result of a mistake or misidentification, and include your name, address, telephone number and your consent to the jurisdiction of the appropriate federal court. We will pass a counter notification on to the complainant.

A caution to complainants

You may be liable for damages, costs and legal fees if you knowingly and materially misrepresent that material is infringing your copyright. The same applies to a customer who misrepresents that material was disabled in error. If you are uncertain, take legal advice before filing.
